TERMS AND REGULSTIONS OF KOKORO KYUDO CLUB
These Terms and Regulations determine the rights and obligations of the Customers of Kokoro Foundation headquartered in Kraków, ul. prof. Tadeusza Seweryna 8/5, hereinafter referred to as the Club.
Kokoro Foundation provides services of teaching kyūdō Japanese archery to Customers over 18 years of age.
§ 1 Customers using Club services must pay for a single training session or a monthly pass according to the current price list. To receive the monthly pass the Customers must familiarize themselves with the Terms and Regulations of the Club and pay the required fee. Paying for a single training or a monthly pass is tantamount to approval of the Terms and Regulations of the Club and General Data Protection Regulation (GDPR; Polish: RODO).
§ 2 The Club does not refund the cost of the monthly pass. If the Customer does not participate in the training sessions, it does not constitute grounds for a refund or extending the pass validity.
§ 3 The Customers participating in the training must bring their own clothes designed for kyūdō practice or a suitable sports outfit. The Customers participating in the training are required to practice wearing tabi or socks, or barefoot.
§ 4 The monthly pass is issued for one calendar month. However, the Club reserves the right not to organize practices during the holiday season.
§ 5 The fee for the monthly pass should be paid no later than on the 10th day of every month. If the payment is not recorded, the fee for participation in the practice would be charged like for a single training session. The fee for a single training session should be paid before the practice or upfront for the whole month.
§ 6 If the Customer has a valid monthly pass but is absent during the training, the training is considered forfeited and does not transfer to the next pass period.
§ 7 The Customer’s private equipment for training can be left in the Club only when tagged with the owner’s name and surname. The equipment without any tags will be removed from the Club or used as the Club’s equipment.
§ 8 The training room, equipment, and sanitary facilities should be used appropriately for their intended use. The Customers are required to keep the sports facility, toilets, and changing rooms clean and tidy.
§ 9 While in the training room, the Customers must follow all comments and recommendations of the Instructors and comply with the Terms and Regulations of the Club.
§ 10 The Customer would be legally or financially responsible for any devastation of the Club equipment and conscious action to the detriment of the Club.
§ 11 In the case of violation of public order or these Terms and Regulations, the Customer would be expelled from the Club and deprived of their membership. The Instructor would verbally inform the Customer about the expulsion decision. In the case of expulsion and ban on the use of the Club services, the fee paid for the monthly pass and used training sessions or any other payments are not refundable.
§ 12 Kokoro Kyūdō Club reserves its right to not grant membership to any Customer without giving any reason.
§ 13 Smoking tobacco and consumption of alcoholic beverages or other psychoactive substances is strictly forbidden on the premises of the Club.
§ 14 If the Customer is late for the training by more than 15 minutes, they cannot participate. The Customer who is late for the training is considered absent, and the prepaid training is considered forfeited.
§ 15 The Customers participating in the training declare that they do not have any health contraindications that would prevent them from doing physical exercises and that they participate at their own risk. Before participating in the training, the Customer suffering from health issues should consult a sports doctor and deliver a medical certificate allowing them to participate in the practice.
§ 16 In the case of malaise, injuries, traumas, any other serious health problems, and pregnancy, the Customer should inform the Instructor about it before the training.
§ 17 Kokoro Kyūdō Club is not liable for accidents and damage resulting from ignoring the training program and the Instructor’s comments and recommendations.
§ 18 The Club reserves the right to change the training schedule and the Club Terms and Regulations. The Customers should be informed about any changes.
§ 19 The Customer is required to familiarize themselves with these Terms and Regulations and follow them and every other regulation valid on the premises of the Club.
§ 20 The Instructors oversee the following of these Terms and Regulations. All requests and complaints should be reported directly to the Owner of the Club.
